WMC cannot find Avermedia H335 tuner until VLC opens

Hi

I have a HP Envy 23 with built in Avermedia H335 tuner upgraded to 8.1 from 8, media centre can't find the tuner on set up or watching live tv unless i try and open the tuner in vlc as soon as i do that media centre will start playing the selected channel and will work fine until play back is stopped then i have to do the same thing with vlc.
i have the latest driver from HP they don't have one listed for 8.1 but do for 8 avermedia's site doesn't list the card at all
